Tally Terms of Use

These Terms of Use (“Terms”) govern your use of Tally (“the app”), an iPhone and Apple Watch application developed by Samuel Petrarca (“we,” “us”). By downloading or using Tally, you agree to these Terms. If you don’t agree, please don’t use the app.
License
Tally is licensed, not sold, to you for personal, non-commercial use on Apple devices you own or control, in accordance with the Apple Standard End User License Agreement (EULA), which also applies to your use of the app. Where these Terms and the Apple Standard EULA conflict regarding the licensed application, the Apple Standard EULA governs.
Subscriptions — Tally Pro
The core of Tally is free: you can log food and use the adaptive calorie target on your iPhone at no charge. Tally Pro is an optional auto-renewable subscription that unlocks history and trends and the Apple Watch app.
- Price: $4.99 per year (USD). Pricing may vary by region and is shown in the App Store before you confirm any purchase.
- Free trial: a 7-day free trial is offered where eligible, once per Apple ID. If you buy during a trial, any unused portion of the trial is forfeited.
- Billing: payment is charged to your Apple ID upon confirmation of purchase.
- Auto-renewal: the subscription automatically renews for the same period at the then-current price unless you turn off auto-renewal at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends.
- Managing & cancelling: you can manage or cancel anytime in your App Store account settings. Cancellation takes effect at the end of the current billing period; partial periods are not refunded except where required by law.
Subscriptions are sold and processed by Apple and are also subject to the Apple Media Services Terms and Conditions. Refunds are handled by Apple.
Not medical or nutritional advice
Tally is a nutrition-tracking tool, not a medical device, and does not provide medical, nutritional, or professional advice. Calorie and macro targets it calculates are estimates. Consult a qualified professional before making changes to your diet, especially if you have a medical condition or an eating disorder. You use Tally at your own risk.
Acceptable use
Please don’t misuse the app — for example, by attempting to reverse-engineer it beyond what the law permits, interfering with its operation, or using it unlawfully.
Disclaimer of warranties
Tally is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including fitness for a particular purpose. We don’t warrant that the app will be uninterrupted, error-free, or that data will always sync or be preserved.
Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of Tally. Our total liability for any claim relating to the app will not exceed the amount you paid for it in the 12 months before the claim.
Apple
Apple is not a party to these Terms and is not responsible for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Changes
We may update the app or these Terms from time to time. Material changes to these Terms will be posted here with a new “Last updated” date; continued use after changes means you accept them.
Governing law
These Terms are governed by the laws of the State of [STATE], United States, without regard to its conflict-of-laws rules, except where Apple’s terms govern matters they cover.
